The Will and Probate of of Edmund Estcourt Gale of Long Newnton, 1770



 
The Will of Edmund Estcourt Gale Clerk rector of Newnton in the County of Wilts & Diocese of Sarum
In the Name of God Amen I Edmund Estcourt Gale of Newnton in the County of Wilts Clerk being Sick and Weak in Body but of sound and disposing mind memory and understanding (thanks be given to Almighty God for the same) Do make publish and declare this my last Will and Testament in manor and form following that is to say —
First I will and direct that all the Just Debts which I shall owe at the time of my Decease shall be fully paid and satisfied by my Executors herein after named within twelve months next after my Decease    And I do hereby charge all my Estates both Real and Personal with the payment thereof
I Give and Devise unto my Friends William Roberts of Newnton in the County of Wilts yeoman and William Gale of Norton in the same County yeoman All that my Close of Meadow or Pasture Ground called Thomas’s Leaze situate in Milborne in the parish of Malmesbury in the County of Wilts To hold to them the said William Roberts and William Gale their Heirs and Assigns In Trust that they my said Trustees and the Survivor of them and the Heirs and Assigns of such Survivor do and shall receive and take the Rents Issues and Profits of the said Close of Meadow or Pasture Ground and pay and apply the same to and for the Maintenance and Education of my Son Edmund Estcourt Gale until he shall attain his Age of twenty one years And when and as soon as he shall have attained his said age of twenty one years I do hereby Will and direct that the said William Roberts and William Gale their Heirs and Assigns shall stand seized and Behoof of my said Son Edmund Estcourt Gale his Heirs and Assigns for ever
I also give Devise and bequeath unto the said William Roberts and William Gale All that my undivided Moiety or half part of and in all those three Messuages or Tenements with the Outhouses Gardens and Appurtenances thereto belonging situate lying and being in Malmesbury in the County of Wilts to hold to them the said William Roberts and William Gale their Heirs and Assigns In Trust that they my said Trustees and the Survivor of them and their Heirs and Assigns of such Survivor do and shall receive and take the Rents Issues and Profits of the said undivided Moiety or half part of the said three Messuages or Tenements with the Outhouses Gardens and Appurtenances thereto belonging and pay and apply the same to and for the Maintenance and Education of my said Son Edmund Estcourt Gale until he shall attain his age of twenty one years And when and as soon as he shall have attained his said age of twenty one years I do hereby Will and direct that the said William Roberts and William Gale their Heirs and Assigns shall stand seized and be possessed of the said undivided Moiety or half part of the said three Messuages or Tenements with the Outhouses Gardens and Appurtenances to and for the use and Behoof of my said Son Edmund Estcourt Gale his Heirs and Assigns for ever
I Give Devise and Bequeath unto the said William Roberts and William Gale All that my undivided Moiety or half part of and in All those two Closes of Meadow or Pasture Grounds commonly called or known by the name of of Davis's situate in the parish of Westport in the County of Wilts to hold to them the said William Roberts and William Gale their Heirs and Assigns In Trust that they my said Trustees and the Survivor of them his Heirs and Assigns do and shall receive and take the Rents Issues and profits of the said undivided Moiety or half part of and in the said two Closes of Meadow or Pasture Grounds and pay and apply the same to and for the maintenance and Education of my said Daughter Jane Gale until she shall attain her age of twenty one years And when and as soon as my said Daughter Jane Gale shall have attained her said age of twenty one years I do hereby Will and direct that the said William Roberts and William Gale their Heirs and Assigns shall stand seized and be possessed of the same Premises to and for the use and Behoof of my said Daughter Jane Gale her Heirs and Assigns for ever
I give the use of all my Household Goods Plate Linnen and Furniture unto my Loving Wife Sarah Gale for and during the Term of her natural Life And after her decease I give the same unto my Son and Daughter Edmund Estcourt Gale and Jane Gale equally to be Divided between them share and share alike
All the rest residue and Remainder of my Real and Personal Estates whatsoever and wheresoever and of what nature kind or quality so ever (not herein before by me otherwise given devised or Disposed of Charges and Chargeable with the payment of all my Just Debts and Funeral Expenses) I give devise and bequeath unto my said Son Edmund Estcourt Gale his Heirs Executors Administrators and Assigns for ever
And I do hereby make nominate constitute and appoint my said loving Wife Sarah Gale and the said William Roberts and William Gale joint Executrix and Executors of this my last Will and Testament and do hereby revoke all former Wills by me made
In Witness whereof I the said William Estcourt Gale have to this my last Will and Testament contained in two sheets of paper to the first sheet thereof sett my hand and to the second sheet sett my hand and seal this Sixteenth Day of July in the year of our lord One Thousand Seven hundred and Seventy

Signed Sealed Published and Declared by the above named Edmund Estcourt Gale the Testator as and for his last Will and Testament in the presence of us who at his request and in his presence and in the presence of each other have hereunto subscribed our names as witnesses thereto

This will was proved at Sarum Sep. 7 1770 before the Rev Richd Keble B.D. the lawful surrogate of the Revd and worshipful John Taylor D.D. of the Diocese of Sarum And by him ? of the Goods of the Testor was granted to Sarah Gale one of the Extors named therein being first sworn by command to the truth of the Will to perform the same and to exhibit an Invty when lawfully required.
