The Will and Probate of Charles Parsons of Marston Magna, 1847

In the Goods of Charles Parsons deceased. In the Consistorial Archdeaconal Court of Wells - 22 July 1847
APPEARED personally Charles Parsons of Stalbridge in the County of Dorset Yeoman one of the Executors named in the Will and Charles Parsons of the Parish of Marston Magna in the County of Somerset the Executor substituted by the codicil of the last Will and Testament of the said Charles Parsons late of the Parish of Marston Magna aforesaid Yeoman who died on the twenty ninth day of August 1846 and made Oath and said that that the Personal Estate and Effects of the said Deceased, for or in respect of which a Probate of the said Will is to be granted by the said court, exclusive of what the Deceased may have been possessed of or intitled to as a Trustee for any other Person or Persons, and not beneficially, and without deducting any thing on account of the Debts due and owing from the Deceased, are under the value of One Thousand Pounds to the best of these Deponents knowledge, information and belief. AND these Deponents lastly lastly made Oath and said that the Deceased was not at the time of his death possessed of or intitled to any Leasehold Estate or Estates for Years either absolute or determinable on a Life or Lives to the best of their knowledge, information and belief.

Sworn on the same day before me ..........

I Charles Parsons of Marston Magna in the County of Somerset Yeoman make my last Will and Testament in manner so following that is to say I give divide and bequeath all my real and personal estate whatsoever and wheresoever to my Cousin James Parsons of Horsington in the County of Somerset Gentleman and my nephew Charles Parsons of Stalbridge Park in the County of Dorset Gentleman to hold to them their heirs Executors and Administrators respectively.
Upon the ? following that is to say. Upon trust to permit and suffer Ann my Wife to occupy and enjoy or receive and take the rents incomes and profits of my Dwelling house Garden and Orchard at Marston Magna aforesaid for and during the term of her natural life save she shall so long continue my Widow and unmarried and from and after her decease or second Marriage which shall first happen Upon Trust for my Son Charles Parsons his Heirs and assigns he paying the cost to my Sons Richard and Uriah and to my Daughters Ann Elizabeth and Mary the sum of Forty pounds sterling a piece but if my said Son Charles shall decline to accept the said premises on such terms then upon trust to my said son Richard his Heirs and assigns he paying ? to his other brother and sister (except his brother Edward Parsons and his Sister Harriet Willis) the sum of Forty Pounds sterling apiece. And if save the said Richard Parsons shall refuse to accept the said premises on such terms Then upon trust to my said Son Uriah his Heirs and assigns he paying the ? to his other brothers and sisters (except the said Edward and Harriet) the sum of Forty pounds sterling a piece. And in case all my said Sons Charles Richard and Uriah shall refuse to take the said premises on the above mentioned terms then upon trust to sell the same ? publicly or privately as my said trustees or the Survivors of them his Heirs ? or ? ? shall ? ? And out of the Monies arising therefrom to pay each of my said Daughters Ann Elizabeth and Mary the sum of Forty Pounds apiece and to pay the residue of such Monies equally between my said Sons Charles Richard and Uriah and as to my said personal estate Upon trust that my said Trustees do and shall pay ? to my said Daughter Harriet Willis for her separate use and so that her receipt alone Shall be sufficient discharge the sum of Eighty pounds sterling in one year after my decease and do ? and shall apply the remainder of my personal estate at their discretion for the benefit of the said Ann my wife and said Sons Charles Richard and Uriah and my said Daughters And Elizabeth and Mary during the life of my said Wife if she should so long continue my Widow and unmarried And from and immediately after her decease or second marriage which shall first happen Upon trust to pay thereon the sum of Forty pounds sterling to each of my said Daughters Ann Elizabeth and Mary and to pay the residue thereof in equal shares between my said Sons Charles Richard and Uriah Provided always that my said Trustees shall not be controlled in any way in the execution of the trusts hereby as reposed in them but shall and may act in all things at their complete discretion and as they shall deem best for my said Wife and children and sell and disperse and convert into Money any personal Estate as they shall think fit or otherwise And I appoint my said Cousin James Parsons and my said Nephew Charles Parsons Executors of this my Will and I give to my said Trustees all protections and indemnities and rights and powers of reimbursing themselves out of the Trust Estates that are usual in like cases. In witness thereof I have hereunto signed and subscribed my name the Fifth day of August 1846 —

This is a Codicil to my above written will. I revoke the appointment of my Cousin the above named James Parsons as one of the Trustees and Executors of my said Will and in lieu thereof I appoint my Son Charles Parsons one of my Trustees and Executors jointly with my above named Nephew Charles Parsons And I give divide and bequeath all my real and personal estate unto my said Nephew Charles Parsons and my said Son Charles Parsons their heirs executors and administrators respectively accordingly Upon the trusts and for the several ? intents and purposes mentioned in my above written will. In witness whereof I have hereunto set my hand the twenty second day of August 1846 —
